Terms of service

The rules that govern periskop.ai, the Periskop API, and the Periskop MCP server. Periskop is the product discovery layer for agentic commerce — not a merchant of record, not a checkout provider, not a guarantee of any purchase.

The service

Periskop is the product discovery layer for agentic commerce. These terms govern your use of periskop.ai (the marketing site and developer surface) and the Periskop API and MCP server(collectively, the “Service”).

The Service turns shopping prompts into structured product discovery results — ranked products, bundles, caveats, match quality, request IDs, image URLs, and links to third-party merchant product pages. The consumer-facing portal periskop.shop is a separate surface with its own terms.

By using the Service you agree to these terms. If you don’t agree, don’t use the Service.

Eligibility and accounts

You must be at least 18 years old (or the age of majority where you live) and capable of entering a binding contract. If you use the Service on behalf of an organisation, you represent that you have authority to bind that organisation to these terms.

You are responsible for the security of any credentials you create and for all activity that takes place under them.

Early access and API access

API and MCP access may require approval. We may grant, decline, or revoke access at our discretion — for example, for abuse, a credible security risk, breach of these terms, or capacity reasons. Access during early-access periods is provided as is and may change as the product evolves.

We may publish or change rate limits, request size limits, quality controls, and feature availability without prior notice. We will use reasonable efforts to communicate material changes to active developers.

User prompts and submitted content

You are responsible for the prompts and content you submit to the Service, including via forms on periskop.ai and via the API or MCP. You represent that you have the right to submit that content and that it does not violate these terms or any applicable law.

You grant Periskop a worldwide, non-exclusive, royalty-free licence to host, process, store, transmit, and analyse the content you submit, solely to operate, secure, debug, and improve the Service in line with our Privacy policy.

Do not submit sensitive personal information (such as health, government-ID, or financial-account data) in prompts unless it is strictly necessary for your use case.

API/MCP use and rate limits

Your API key is yours alone. Don’t share it, embed it in client-side code, or expose it to untrusted parties. Treat MCP credentials the same way.

You must not:

  • Exceed published rate limits or otherwise interfere with the availability or integrity of the Service.
  • Circumvent access controls, quotas, security measures, or usage logging.
  • Use the Service to train a competing product discovery layer (for example, by systematically distilling Periskop outputs for that purpose).
  • Resell, sublicense, or proxy raw API access to third parties outside the scope of your account’s permitted use, unless we agree in writing.

No checkout. No merchant-of-record role.

Periskop is not a merchant of record. Periskop does not process payments, carts, orders, fulfilment, or returns. Any purchase happens on the merchant’s own site under the merchant’s own terms.

Periskop outputs are product-discovery information: ranked products, bundles, caveats, match quality, and merchant links. They are not a purchase offer, a guarantee that any product is available, or financial, legal, medical, or other professional advice.

Separately, developers may purchase Periskop API/MCP usage credits (“top-ups”) to call the Service. Those credit purchases are payments to Periskop for use of the API/MCP and are unrelated to any purchase a consumer makes on a third-party merchant’s site.

No guarantee of product results

The Service is informational. We do not guarantee that any product returned is in stock, accurately priced, suitable for your purpose, free of defects, legal in your jurisdiction, or available from the linked merchant. You and your end users are responsible for the final purchase decision.

Acceptable use

You must not use the Service to:

  • Violate applicable law, infringe intellectual-property rights, or facilitate fraud.
  • Surface products that are illegal to sell in the end-user’s jurisdiction, products targeting minors with adult content, or products that violate applicable safety regulations.
  • Generate, request, or process content that is hateful, harassing, sexual involving minors, or designed to facilitate violence.
  • Send malware, run network attacks, probe vulnerabilities you are not authorised to test, or otherwise threaten the security of the Service or other users.
  • Misrepresent Periskop outputs as your own original engine, or misrepresent the nature of merchant links to end users.

Prohibited scraping, abuse, and circumvention

Don’t scrape the Service through means we have not made available (for example, by automating the marketing site or the consumer portal in lieu of the API). Don’t attempt to bypass rate limits, quotas, or anti-abuse systems, and don’t aggregate or relay API outputs in a way that circumvents your account’s permitted use.

Intellectual property

Periskop, its logos, the website, the API/MCP, and the underlying recommendation engine — including all related software, models, prompts, data structures, and outputs as combined and presented by us — are owned by Periskop or its licensors and are protected by intellectual-property law.

Subject to these terms, we grant you a limited, non-exclusive, non-transferable, revocable licence to access and use the Service for your permitted internal and product use. Merchant product data, names, and images referenced by Periskop remain the property of the respective merchants.

Suspension and termination

We may suspend or terminate your access (in whole or in part) if we reasonably believe you have breached these terms, if your use poses a security risk, if required by law, or for non-payment (where applicable). We may also discontinue the Service or any part of it.

You may stop using the Service at any time. Termination does not relieve you of obligations accrued before termination, including liability for misuse.

Disclaimers

The Service is provided “as is” and “as available”. To the maximum extent permitted by law, Periskop disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, and accuracy of outputs.

We do not warrant that the Service will be uninterrupted, error-free, secure, or that any product information returned will be accurate, complete, or available from the linked merchant. Outputs may reflect biases or limitations of underlying data and models.

Limitation of liability

To the maximum extent permitted by law, Periskop is not liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, or business opportunity, arising out of or in connection with the Service.

Periskop’s total aggregate liability arising out of or in connection with the Service is limited to the greater of (a) the amounts you have paid to Periskop for the Service in the twelve months preceding the event giving rise to the claim, or (b) one hundred US dollars (US$100).

Nothing in these terms excludes or limits liability that cannot be excluded or limited by law.

Indemnity

You will indemnify, defend, and hold harmless Periskop and its officers, employees, and agents from and against any claim, loss, liability, or expense (including reasonable legal fees) arising out of or related to (i) your use of the Service in violation of these terms, (ii) content you submit to the Service, or (iii) your violation of applicable law or third-party rights.

Privacy

Our handling of personal data is described in the Privacy policy. The Privacy policy and these terms work together.

Changes

We may update these terms. Material changes will be reflected in the “Last updated” date and, where appropriate, flagged through the Service or other communication channels. Continued use of the Service after a change means you accept the updated terms.

Governing law and venue

These terms are governed by, and construed in accordance with, the laws of the jurisdiction in which the Periskop entity providing the Service is established, without regard to its conflict-of-laws rules. The courts of that jurisdiction have exclusive jurisdiction over disputes arising out of or in connection with these terms, unless a non-waivable consumer right gives you the option to bring proceedings elsewhere.

Where mandatory local law gives you stronger rights, those local rights apply notwithstanding the foregoing.
